At Ditching the 9-5 LLC (D9-5), we are committed to delivering high-quality services in a timely, efficient, and professional manner. This Fulfillment Policy outlines our approach to ensuring the successful completion of services in line with the terms and conditions established in our Agreement with you, the Client.

All services are designed to improve your business efficiency, streamline operations, and enhance customer engagement. All services will be carried out with the highest standard of professionalism, in accordance with industry best practices and legal requirements.

Payment and Invoice Terms:

  • Prepayment Requirement: All services must be prepaid before the Contractor begins work. Invoices are issued in advance for the number of hours requested, with payment due upon receipt.

  • Compensation: Client shall pay D9-5 the fees in US dollars. Invoices are sent via email. The Client is encouraged to pay invoices upon receipt to avoid accidental late payments which will incur late fees. All acceptable methods of payment will be indicated on the invoice.

  • Credit Cards We Accept
    We accept payments via credit card (Visa, MasterCard, American Express, Discover) and other secure methods. These logos are displayed at checkout to ensure you know the payment options available. All transactions are processed securely through our payment processor.

  • Timely Payment: The Client is encouraged to settle invoices promptly to avoid delays in service delivery.

  • Late Payment: If payment is delayed or not received on time, services will be paused until the outstanding balance is cleared. If services are delayed due to late payment, we are not liable for any missed deadlines.

  • Failure to Pay. If Client has not paid its invoice by the due date, Client understands and agrees that:

    • All work will be temporarily discontinued after a 3-day grace period until payment is received.

    • The client will be charged a late fee of 25% of the total amount due on a weekly basis until payment is received

    • Permanent suspension of services will occur if payment is not received within 14 calendar days of the invoice due date.

    • In the event that Contractor incurs legal fees, costs, or disbursements in an effort to collect its invoices, in addition to interest on the unpaid balance, Client agrees to reimburse Contractor for all such expenses.

 

Service Adjustments and Additional Work:

  • Scope Changes: If the Client requires new work outside the original service scope, we will provide a cost estimate for approval before commencing the work. Payment for additional work will be required prior to delivery of the finished product.

  • Termination and Refunds: This Agreement may be terminated by either party at any time, but no refunds will be issued for hours not worked at the time of termination. Any unused hours will remain the property of Ditching the 9-5 LLC.

  • Cancellation Policy: Clients may cancel services with written notice prior to the start of any new work. Cancellations after work has begun will be subject to payment for the hours worked.

 

Confidentiality and Data Protection:
We prioritize safeguarding your business information. All materials shared with us will be handled with confidentiality. The Contractor will only use this information to perform the services outlined in the Agreement and will not disclose it to third parties unless explicitly authorized by the Client. 


Legal or Export Restrictions
Certain services provided by D9-5 may be subject to restrictions in specific regions or industries. We do not provide services to individuals or entities located in restricted jurisdictions under applicable law.

Privacy Policy
This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from ditchingthe9-5.com (the “Site”).

  • Personal information we collect: When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Data retention: When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Children's Privacy:  The Site is not directed to children under the age of 13 and we do not knowingly collect personal information from children under the age of 13 on the site. Refund, Return, and Cancellation Policy


Refund Policy: Due to the nature of the services provided, no refunds will be issued for hours not worked at the time of termination or cancellation. Refunds may be considered for unused services under specific conditions, subject to review.
Return Policy: As services are digital and not physical goods, a return policy does not apply.
Cancellation Policy: Clients may cancel services with written notice at any time before work begins. Once work commences, services are non-refundable, and clients are responsible for payment for hours worked.
 
Termination of Services
This agreement will continue until either:

  • Written termination notice from either party.

  • The completion of hours paid for in the most recent retainer.

Upon termination, all work completed by the Contractor will remain the property of the Client. The Client remains responsible for payment for all hours worked up to the point of termination, regardless of whether the services have been completed.

Subcontractors
We may, at our discretion, engage subcontractors to assist with service delivery. In such cases, the subcontractor is considered an agent of D9-5, and the Client will not engage third parties to assist with the services provided by the D9-5.
 
Service Guarantee
While we strive to deliver services that meet or exceed Client expectations, Ditching the 9-5 LLC does not guarantee specific results from the services rendered. We will apply industry best practices and utilize proven strategies, but performance outcomes may vary due to factors outside our control. If specific outcomes or results are desired, please communicate these goals before the start of the project.
